Terms of Use — Toksik: Diari IA i Estat d Ànim

This End-User License Agreement and Terms of Service ("EULA") is a legal agreement between you ("End-User") and Vladislav Gorovenko, Individual Entrepreneur ("Developer," "we," "our," or "us"), located at Batumi, Georgia. This EULA governs your use of the Toksik mobile application (the "Licensed Application").

By downloading, installing, or using the Licensed Application, you agree to be bound by this EULA. If you do not agree, do not download, install, or use the Licensed Application.

You and the Developer acknowledge that this EULA is concluded between the Developer and the End-User only, and not with Apple Inc. ("Apple"). The Developer, not Apple, is solely responsible for the Licensed Application and the content thereof. This EULA incorporates the Usage Rules and does not conflict with the Apple Media Services Terms and Conditions.

• Toksik is local‑first. Your entries and settings stay on your device.
• The only time content leaves your device is when you explicitly press the AI button to use AI Insights; then only the necessary text is sent to our model provider for inference and is not stored by us. See the Privacy Policy for details.
• We do not run ads or tracking at this time. If this changes in the future, we will update our policies and in‑app disclosures before enabling ads.

The Licensed Application is not intended for children under the age of 13. By using the Licensed Application, you represent that you are at least 13 years of age. The Licensed Application is not a medical or psychological service and does not provide medical advice. For health concerns, consult a qualified professional.

Toksik is an AI-powered emotion diary that helps users track negative emotions, journal daily, and generate on-demand AI reports to identify stress and anxiety patterns. Users record their feelings throughout the day and, after at least 7 days of journaling, can request an AI-powered analysis of their emotional patterns. AI analysis is available with an active subscription.

The Developer grants you a limited, non-exclusive, non-transferable, revocable license to use the Licensed Application on any Apple-branded products that you own or control and as permitted by the Usage Rules set forth in the Apple Media Services Terms and Conditions. The Licensed Application may also be accessed and used by other accounts associated with you via Family Sharing or volume purchasing. This license is for personal, non-commercial purposes only, subject to this EULA.

• The Licensed Application does not require an account.
• Premium features (e.g., AI Insights) may require a subscription via the Apple App Store. Subscriptions are billed through your Apple ID. Payment will be charged to your Apple ID at confirmation of purchase.
• Subscriptions automatically renew unless canceled at least 24 hours before the end of the current billing period. Your account will be charged for renewal within 24 hours prior to the end of the current period.
• Subscription pricing and duration are displayed in the Licensed Application before purchase. You can manage or cancel your subscription at any time in your Apple ID account settings. We do not process payments directly and do not have access to your payment information. All billing, refunds, and subscription management are handled by Apple.

• On‑demand: AI processing occurs only when you explicitly trigger it by pressing the AI button.
• Data handling: only the minimal necessary text is sent to our AI model provider to generate a response. We do not collect, log, or store your entries on our servers. Inputs and outputs are not stored server‑side by us.
• Output: generated responses are shown in the app and saved locally on your device if you choose to keep them.
• We do not guarantee the accuracy, completeness, or usefulness of AI-generated insights. AI reports are for self-reflection purposes only and should not be considered medical or psychological advice.

You retain all rights to journal entries and content you create in the Licensed Application. You are responsible for backing up your data. If you delete the Licensed Application or use the in‑app delete‑all function, your local data is permanently removed from your device and cannot be recovered.

You agree not to:

• Use the Licensed Application for unlawful purposes.
• Attempt to reverse engineer, interfere with, or disrupt the Licensed Application.
• Upload content that is illegal, harmful, or violates third‑party rights.

We reserve the right to restrict, suspend, or terminate access to the Licensed Application for violations of this EULA.

The Developer is solely responsible for providing any maintenance and support services with respect to the Licensed Application, as specified in this EULA or as required under applicable law. You and the Developer acknowledge that Apple has no obligation whatsoever to furnish any maintenance and support services with respect to the Licensed Application. The Developer is solely responsible for any product warranties, whether express or implied by law, to the extent not effectively disclaimed. In the event of any failure of the Licensed Application to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price for the Licensed Application to you. For subscriptions and in-app purchases, refunds are handled by Apple under Apple’s policies. To the maximum extent permitted by applicable law, Apple will have no other warranty obligation whatsoever with respect to the Licensed Application, and any other claims, losses, liabilities, damages, costs, or expenses attributable to any failure to conform to any warranty will be the Developer’s sole responsibility.

The Licensed Application is provided "AS IS" and "AS AVAILABLE." The Developer does not guarantee uninterrupted or error-free operation. AI-generated insights are provided for self-reflection purposes only and may not be accurate or complete.

You and the Developer acknowledge that the Developer, not Apple, is responsible for addressing any claims of the End-User or any third party relating to the Licensed Application or your possession and/or use of the Licensed Application, including, but not limited to: (i) product liability claims; (ii) any claim that the Licensed Application fails to conform to any applicable legal or regulatory requirement; and (iii) claims arising under consumer protection, privacy, or similar legislation.

The Licensed Application, including its software, design, and branding, is owned by the Developer and protected by applicable intellectual property laws. You may not copy, modify, or distribute the Licensed Application except as permitted by law.

You and the Developer acknowledge that, in the event of any third-party claim that the Licensed Application or your possession and use of the Licensed Application infringes that third party’s intellectual property rights, the Developer, not Apple, will be solely responsible for the investigation, defense, settlement, and discharge of any such intellectual property infringement claim.

You represent and warrant that (i) you are not located in a country that is subject to a U.S. Government embargo, or that has been designated by the U.S. Government as a "terrorist supporting" country; and (ii) you are not listed on any U.S. Government list of prohibited or restricted parties.

You must comply with applicable third-party terms of agreement when using the Licensed Application. For example, if you use the Licensed Application over a wireless data connection, you must not violate your wireless data service agreement.

To the maximum extent permitted by applicable law, the Developer is not liable for indirect, incidental, special, consequential, or punitive damages. The Developer is not responsible for data loss on your device. The Developer’s total liability will not exceed the amount paid by you for the subscription in the preceding 12 months. This EULA does not limit the Developer’s liability to the End-User beyond what is permitted by applicable law.

You and the Developer acknowledge and agree that Apple, and Apple’s subsidiaries, are third-party beneficiaries of this EULA. Upon your acceptance of the terms and conditions of this EULA, Apple will have the right (and will be deemed to have accepted the right) to enforce this EULA against you as a third-party beneficiary thereof.

We may update this EULA from time to time. Continued use of the Licensed Application after updates constitutes acceptance of the revised EULA.

This EULA is governed by the laws of Georgia, excluding conflict of laws rules, except where consumer protection laws in your country of residence require otherwise.
